HerdWhistle Privacy Policy

These terms are subject to legal review and may be updated.

Effective date: October 11, 2026

1. Who we are

HerdWhistle Technologies Inc. ("HerdWhistle", "we", "us") is a company based in Calgary, Alberta, Canada. We design and sell satellite-connected livestock and animal-monitoring hardware, including the CattleShield Collar, the CattleShield Tag and the HerdWhistle Tag family (HerdWhistle 1000, 500, 250 and 100 Tags), and related subscription services, apps and data products.

This policy explains what information we collect, why, how we use and share it, where it is stored, how long we keep it, and the choices and rights you have. It applies to:

  • our website, herdwhistle.com, and its forms;
  • reservations, deposits and payments;
  • our mobile app and web app; and
  • data collected by our devices and used in our subscription tiers.

This policy does not cover BigEye products, which are sold under separate contracts.

2. Key terms

"Personal information" means information about an identifiable individual (in Brazil, "personal data" under the LGPD). It can include a rancher's name and contact details and, in some cases, the location of a farm or herd that can be linked to a person.

"Device Data" means data collected, generated or transmitted by our devices, as described in section 4.

"Farm and animal data" means information about animals, herds, land, environment and operations that we receive from devices or from you.

"Aggregated and anonymized data" means data combined across many customers and processed so that it no longer identifies a person.

3. Information we collect through our website, forms and payments

Register-interest and reservation forms: name, organization, email, phone, country and region, role (for example rancher, distributor, researcher or conservation group), species, herd size range, Products and quantities, subscription-tier interest, preferred language, comments and consent choices. We use this to respond to you, process your reservation, route you to direct sales or an authorized distributor, and keep a record of your request.

Distributor inquiries: contact details, company details, territory and business information you choose to provide, to evaluate distribution partnerships.

Contact form, email and phone: whatever you choose to tell us, so we can respond.

Orders and invoices: billing name and address, tax identifiers where required, order details, and delivery and collection details, to fulfil your order and meet tax and accounting obligations.

Payments. We use Stripe (card payments, including Visa and Mastercard) and Wise (bank transfers) as payment service providers. When you pay by card, your card details are collected and processed by Stripe; we do not receive or store your full card number. We receive limited payment information, such as the payer name, amount, currency, date, the last digits of the card and payment status. When you pay by bank transfer through Wise, we receive the payer name, the paying bank details shown on the transfer, the amount and the reference. Stripe and Wise also process your information under their own privacy notices, including for fraud prevention and legal compliance.

4. Information collected by HerdWhistle devices

Depending on the Product and its configuration, our devices may collect and transmit:

  • Location: satellite positioning (GNSS) position and time, and movement tracks.
  • Movement and behaviour: motion-sensor readings and the behaviour patterns derived from them (for example grazing, resting, walking).
  • Environment (microclimate): for example air temperature, humidity, barometric pressure, light and rain occurrence.
  • Near-body temperature: temperature at the device on the animal.
  • Virtual-fence data: fence boundaries you set, cue and stimulus events, and containment events (CattleShield Collar).
  • Pairing data: links between a CattleShield Tag on a calf and a CattleShield Collar on its dam.
  • Device status: device ID, power and solar charging status, signal and link quality, firmware version and error logs.
  • Identification: an RFID identifier, only where required by regulation or requested by you.

The exact sensors differ by Product and will be described in each Product's documentation. You may also give us information about your animals, herds and land (for example animal IDs, breed, pasture boundaries and management records) through our apps.

Device Data travels through satellite and short-range links (such as Bluetooth and ultra-wideband) to our systems. Our satellite connectivity provider transmits the data for us.

5. How we use information

We use information to:

  • respond to inquiries, process reservations, deposits, balances and refunds, and fulfil orders;
  • provide, operate, secure and support the Products, apps and services, including virtual fencing and over-the-air updates;
  • provide the insights in your subscription tier;
  • develop and improve our products, models and services;
  • build data sets, including phenotypic (observable trait and behaviour) data, animal trends and microclimate data;
  • provide data products to third parties under Tier 4, as described in section 6;
  • send you service messages and, with your consent, marketing messages (section 12);
  • meet legal, tax, accounting and regulatory obligations, including animal-identification or traceability rules where they apply; and
  • protect our rights and prevent fraud and misuse.

Consent. We ask for your consent when you submit a form and again, explicitly, when you start using our devices and apps. You can withdraw consent as described in section 10, but some services cannot be provided without certain information.

6. Data ownership and use across subscription tiers

Ownership. HerdWhistle owns all data collected through our devices, apps and services across Tiers 1 to 4, to the fullest extent permitted by law. This includes Device Data, farm and animal data, anonymized data, phenotypic data and trends, and microclimate data.

Individual personal data is excluded. Personal information about identifiable individuals is not owned by HerdWhistle in a way that removes your rights. It is handled under this policy and applicable privacy law, and your rights under section 10 always apply.

Where the law prohibits this model. We do not claim data rights that are clearly unlawful in a country. If the law of a country prohibits this data model, HerdWhistle does not offer its Products or services in that country.

Tier 1 (free). Tier 1 includes the virtual fencing service free of charge, in exchange for HerdWhistle's data rights described in this section.

Tier 2 (US$75 per head per year) provides breeding insights and behaviour insights.

Tier 3 (US$125 per head per year) provides advanced health indicators + phenotypic data, mainly for scientists and advanced ranchers. These are data insights, not veterinary diagnosis.

Tier 4 (data products). Tier 4 is our data business. We combine data from our device network, including phenotypic animal data and microclimate data, and may license data products and insights to third parties such as agri-food, agricultural-input, research and land-management organizations, and precision-farming and rotational-grazing partners. Revenue from data products helps us keep rancher tools free or low-cost.

Your access. You can see your own animals' data in our apps while you have an account, and your data history stays available to you if you change tiers.

7. How we share information

We share information only as described here:

  • Service providers that act for us, such as payment providers (Stripe and Wise), our website platform and form provider, analytics (Google Analytics), satellite connectivity, cloud hosting, email and customer-relationship tools, and engineering and manufacturing partners where they need access to support devices. They may use the information only to provide services to us.
  • Authorized distributors, where your inquiry or order is handled by a distributor in your country, and for warranty and returns.
  • Services you choose to connect to your account.
  • Tier 4 data customers, as described in section 6.
  • Authorities, where required by law, court order or a mandatory animal-identification or traceability regime.
  • Business transfers, such as a merger, financing or sale of all or part of our business, subject to this policy.
  • Anyone else, with your consent.

We do not sell personal information for others' marketing.

8. Where information is stored and international transfers

We are based in Canada and serve customers worldwide, including in Africa, South America and North America. Information may be stored and processed in Canada and in other countries where our service providers operate. When information is transferred to another country, it is subject to that country's laws and may be accessible to its authorities. We use contractual and other safeguards to protect information that is transferred.

9. How long we keep information

We keep personal information only as long as needed for the purposes in this policy and to meet legal, tax and accounting requirements. Order, payment and tax records are kept for the period required by law. Account information is kept while your account is active and for a reasonable period afterwards. Aggregated and anonymized data, which no longer identifies you, may be kept indefinitely.

10. Your rights and choices

Depending on where you live, you may have the right to:

  • ask whether we hold personal information about you and get access to it;
  • ask us to correct inaccurate information;
  • withdraw consent, subject to legal or contractual limits and reasonable notice;
  • ask us to delete information or stop certain processing, where the law allows;
  • receive your information in a portable format, where the law provides this; and
  • complain to a privacy regulator, such as the Office of the Privacy Commissioner of Canada, the Office of the Information and Privacy Commissioner of Alberta, or Brazil's National Data Protection Authority (ANPD).

To make a request, contact us using section 15. We may need to verify your identity. We will respond within the time required by law.

11. Cookies and analytics

Our website uses cookies and similar technologies:

  • Essential cookies, needed for the site and forms to work and to protect against spam.
  • Analytics cookies: we use Google Analytics to understand how visitors use the site (for example pages visited, approximate location, device and browser type). Google processes this information under its own terms.
  • Language preferences, to show the site in your chosen language.

You can control cookies through your browser settings.

12. Marketing communications

We send marketing emails only with your consent, and every marketing email includes a way to unsubscribe. Service messages about your order, account or devices are not marketing and are sent as needed.

13. Security

We use administrative, technical and physical safeguards designed to protect information, appropriate to its sensitivity, including the sensitivity of animal and herd location data. No system is completely secure. If a breach creates a real risk of significant harm, we will notify affected individuals and regulators as required by law.

14. Children

Our website and services are intended for businesses and adults. We do not knowingly collect personal information from children.

16. Changes to this policy

We may update this policy. We will post the updated version with a new effective date and, for material changes, notify account holders before the change takes effect.
